Why Non-Attorney Representation Is Allowed

Many employees are surprised to learn that you do not need an attorney to receive representation during the administrative stages of an EEO complaint.
Federal regulations allow employees to designate a representative of their choosing, including a consultant or advocate, to assist them throughout the EEO process.
This right is established under 29 CFR § 1614.605, which allows individuals to appoint a representative during the federal EEO complaint process.
Similarly, individuals filing discrimination charges with the U.S. Equal Employment Opportunity Commission in the private sector are not required to have legal counsel to participate in the administrative complaint process.

Tier 1: Case Strategy & Complaint Preparation

Investment: $2,500
Service Period: Up to 30 days
This service is designed for employees preparing to initiate an EEO complaint or EEOC discrimination charge.
The focus of this phase is to build the strategic and evidentiary foundation of the case before a formal complaint is filed.

Services May Include

• Comprehensive case intake and strategy consultation
• Review of workplace events and relevant documentation
• Identification of potential discrimination or retaliation claims • development of an EEO Claim Summary Chart
• Organization of supporting evidence and documentation
• Witness identification and relevance analysis
• Preparation for EEO counseling or EEOC intake discussions
• Guidance on preparing the formal complaint

Client Deliverables

This phase helps ensure the case is organized, documented, and strategically positioned before entering the formal complaint process.


Tier 2: Formal Complaint & Investigation Support

Retainer: $3,500
Includes: up to 14 hours of services
Service Window: up to 120 days
This service provides strategic advocacy and case support for clients who have filed a formal EEO complaint or EEOC charge and are entering the investigation stage.

Services May Include

• Review and finalization of the formal complaint or EEOC charge
• Analysis of agency acceptance or dismissal decisions
• Preparation for investigator interviews
• Drafting or editing sworn affidavits
• Evidence submission strategy and documentation organization
• Guidance on responding to investigator inquiries
• Ongoing case strategy consultations

Additional services beyond the retainer are billed at $250 per hour, billed in 15-minute increments.
If representation is needed beyond the initial service window, services may continue hourly or under a renewed retainer agreement.


Tier 3: Advanced Advocacy & Case Development

Rate: $250 per hour
For employees pursuing settlement negotiations, EEOC hearings, or complex case development, additional advocacy services are available.

Services May Include

• Review of the investigative record or Report of Investigation
• Preparation for EEOC administrative hearings
• Settlement negotiation strategy
• Development of detailed case narratives
• Witness preparation guidance
• Coordination with retained legal counsel when applicable
